General Terms and Conditions of Sale (GTCS)

These General Terms and Conditions of Sale («GTCS») apply to all orders placed on the tellsshoes.ch (the «Site»), operated by :

1) Purpose and scope

The T&Cs govern the sale of products offered on the Site (in particular shoes designed to support comfort and certain specific needs, including those of diabetics), as well as the contractual relationship between Tells Shoes Sàrl («We») and any person placing an order («You»).

2) Products - information and use

The essential characteristics of the products (descriptions, sizes, colours, prices) are indicated on the Site.

Our products provide comfort and support in everyday life. They do not replace medical advice, diagnosis or treatment. If in doubt (e.g. pathology, wounds, neuropathy), it is advisable to seek professional medical advice.

The photos are illustrative: slight variations (colour, texture) may exist depending on the screen and/or production.

3) Create an account (if applicable)

Some features may require you to create an account. You are responsible for the confidentiality of your login details and the actions carried out via your account.

4) Conclusion of the contract

The ordering process on the Site follows the stages indicated (basket, contact details, choice of delivery, payment). The contract is deemed to have been concluded when :

  • you confirm the order (confirmation action), and
  • we will send you an order confirmation by e-mail (or confirm acceptance of the order).

The online seller must provide clear information about its identity and the stages involved in concluding the contract.

5) Prices

Prices are quoted in Swiss franc.
Unless otherwise stated, prices include applicable Swiss VAT (where applicable) and do not include delivery charges, displayed before final validation of the order.

We may change prices at any time, but the price invoiced will be that displayed at the time the order is placed.

6) Payment

Payment is made using the methods offered on the Site (e.g. card, bank transfer, TWINT, etc. - to be specified according to your configuration).
The order is paid immediately (unless explicitly stated otherwise).

If payment is refused or fraud is suspected, we may suspend or cancel the order.

7) Delivery - deadlines - costs

We deliver to the zones indicated when the order was placed (to be completed: Switzerland only / Switzerland + Europe, etc.).

  • Deadlines Delivery times are indicative only (except in cases of force majeure).
  • Fees calculated and displayed before final validation.
  • Address You are responsible for the accuracy of the delivery information.

Unless otherwise stipulated, the risk passes to the customer when the parcel is handed over (in accordance with the rules applicable to transport and the type of delivery).

8) Availability

Our offers are valid while stocks last.

If a product is unavailable after an order has been placed, we will inform you and offer a replacement, postponement or refund, as appropriate.

9) Reservation of ownership

The products remain our property until full payment of the price, interest and any costs.

10) Returns - exchanges - “right of withdrawal”

Switzerland : Swiss law does not not general right of withdrawal for online purchases.

However, on a commercial basis, we can offer a voluntary return policy (below). You can adjust the conditions.

10.1 Voluntary return (trade policy - Switzerland)

We grant a 14-day period upon receipt to request a return, subject to the following conditions:

  • Product nine, unworn, unwashed, in perfect condition
  • In its original packaging
  • Proof of purchase

The following are excluded Customised products, “final sale” promotions (if indicated), products showing signs of use.

Return costs (please select and specify)

  • ☐ at the customer's expense
  • ☐ taken care of by us (only if fault/error on our part).

After acceptance and inspection, we proceed with :

  • or to a exchange,
  • or to a have,
  • or to a reimbursement (indicative lead time: 5-10 working days), depending on the option chosen.

10.2 EU/EEA customers (if you deliver to the EU/EEA)

If you sell/deliver to consumers in the EU/EEA, a 14-day statutory right of withdrawal applies in principle to distance selling, with specific information rules.

➡️ In this case, it is strongly recommended that you add an appendix “EU withdrawal form” with full details (deadlines, refunds, exceptions).

11) Warranty - defects

In the event of default, Swiss law provides for the possibility of :

  • request cancellation of the sale,
  • request a price reduction,
  • or require replacement in certain cases, depending on the legal conditions.

In principle, the warranty period (limitation period for warranty claims) is 2 years from the date of delivery for movable property.

The following are not covered: normal wear and tear, misuse, improper maintenance or damage caused by the customer.

Procedure All complaints should be addressed to Info@tellsshoes.ch with photos, a description of the fault and the order number.

12) Liability

We are liable to the full extent of the law.
Except in the case of gross negligence or wilful misconduct, our liability is limited to direct and foreseeable damage relating to the order, to the extent permitted by applicable law.

We are not liable for indirect damage (loss of earnings, loss of business, etc.) to the extent permitted by law.

13) Data protection

We process your personal data in accordance with our Privacy Policy available on the Site.

14) Intellectual property

All Site content (text, images, logos, trademarks, design) is protected. Any unauthorised reproduction is prohibited.

15) Changes to the General Terms and Conditions

We may amend the GTC at any time. The applicable version is the one in force at the time the order is placed.

16) Applicable law and place of jurisdiction

These General Terms and Conditions of Sale, as well as any contract concluded via the Site, are subject to the laws of the French Republic. Swiss law, to the exclusion of conflict of laws rules.

In the event of a dispute, the parties shall endeavour to find an amicable solution.

Failing agreement, the courts of Tells Shoes Sàrl's registered office shall have jurisdiction, subject to the applicable mandatory provisions (in particular with regard to consumer protection).
